Law firm Chimicles Schwartz Kriner & Donaldson-Smith (CSK&D) has filed a class-action lawsuit against both Sony Corporation of America and Sony Interactive Entertainment in regards to reports of PlayStation 5 DualSense drift issues. The filing comes after CSK&D explored the possibility of class action and put out a public form for consumers to report their own DualSense issues.
The official complaint, which was filed by the United States District Court for the Southern District of New York on behalf of a plaintiff named Lmarc Turner, along with other consumers, details the defect and its effects on the controller. “Specifically, the DualSense controllers that are used to operate the PS5 contain a defect that results in characters or gameplay moving on the screen without user command or manual operation of the joystick,” the filing states. “This defect significantly interferes with gameplay and thus compromises the DualSense controller’s core functionality.”
The complaint is asking for a jury trial with the plaintiff looking for financial compensation “for damages suffered, declaratory relief, and public injunctive relief.”
CSK&D is the same law firm that also filed a lawsuit against Nintendo for Joy-Con drift issues. In response to those reports, Nintendo of America president Doug Bowser stated in an interview that the company is “continuously looking at ways to improve our products as we go forward.” The company has also been offering free repairs through their official site to anyone experiencing Joy-Con drift. Sony has yet to officially respond to their own drift dilemma.
